Terms of Service

1. Overview

These Terms of Service ("Terms") apply to the tresswellness.com website (the "Site") and the WaxPal mobile application (the "App"), together the "Services". The Services are operated by Fxswede AB, trading as Tress Wellness ("Tress Wellness", "we", "us" or "our"). By visiting the Site, using the App or buying from us, you agree to these Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and Cancellation Policy, which form part of these Terms. If you do not agree, please do not use the Services.

Our online store is hosted on Shopify. Some features of the Services may be provided by other third-party service providers, as described in our Privacy Policy.

2. Eligibility and accounts

You must be at least the age of majority where you live to place an order. You must be at least 13 years old to create an App account or use the App community features.

If you create an account, please keep your login details secure and make sure the information you give us is accurate. You are responsible for activity carried out through your account. We may suspend or close an account that breaks these Terms or is used in a way that could harm other users or the Services.

3. Products, prices and orders

We try to describe and show our products as accurately as possible, but colours and images may vary slightly depending on your screen, and packaging may change over time. Prices, products and offers may change without notice and are subject to availability.

An order is an offer to buy. We may refuse or cancel an order, or limit quantities, for example where a product is unavailable, where there is an obvious pricing or description error, or where we suspect fraud or resale. If we cancel an order you have paid for, we will refund you in full.

4. Payment and billing

You agree to provide current, complete and accurate billing and contact information. Payments are processed securely by our payment providers; we do not store full card details.

If you choose a Subscribe & Save subscription, you authorise us to charge your payment method automatically for each delivery at the frequency you selected until you cancel. You can change, skip or cancel at any time before your next billing date, as described in our Cancellation Policy.

5. Shipping, returns and cancellations

Delivery is covered by our Shipping Policy. Returns, refunds and exchanges are covered by our Refund Policy. Order cancellations are covered by our Cancellation Policy. Nothing in these Terms affects your statutory rights as a consumer.

6. Using our products safely

Always read and follow the directions and warnings supplied with our products, including any recommended patch test. Information in the Services, including tutorials, tips and community posts, is for general information only and is not medical advice. If you have a skin condition, are taking medication or have any concerns, please speak to a healthcare professional before use.

7. The WaxPal App and the Tress Tribe community

The App is made available through the Apple App Store and Google Play and is also subject to their terms. Apple and Google are not responsible for the App or its content. We may update, change or withdraw App features at any time.

You keep ownership of the content you post in the App, such as posts, comments and photos. By posting, you give us a non-exclusive, royalty-free, worldwide licence to host, display, reproduce and share that content within the Services and in connection with operating and promoting them. Please only post content you have the right to share.

When using the community you agree not to post anything unlawful, harmful, harassing, hateful, explicit, misleading or spam, not to share other people's personal information, and not to impersonate anyone. We may review, moderate or remove content and restrict accounts at our discretion. You can report content or users to us at any time.

8. Rewards

Where the App offers rewards or points, they have no cash value, cannot be transferred or sold, and can only be used as described in the App. We may change, suspend or end the rewards programme, and may cancel points that were earned through error, misuse or in breach of these Terms.

9. Third-party tools and links

The Services may include links to, or tools provided by, third parties. We do not control and are not responsible for third-party websites, tools or content. Your use of them is at your own risk and subject to their terms.

10. Intellectual property

The Services and their content, including text, images, videos, logos and the Tress Wellness and WaxPal names, belong to us or our licensors. You may not copy, reproduce, sell or exploit any part of the Services without our written permission.

11. Prohibited uses

You may not use the Services for any unlawful purpose; to infringe anyone's rights; to upload viruses or malicious code; to collect other users' personal information; to scrape, spam or interfere with the Services or their security; or to submit false or misleading information.

12. Disclaimer and limitation of liability

We work to keep the Services available and accurate, but we cannot guarantee they will always be uninterrupted, error-free or up to date. To the extent permitted by law, the Services are provided "as is" and "as available".

To the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including your statutory rights as a consumer.

13. Indemnification

To the extent permitted by law, you agree to indemnify us against claims arising from your breach of these Terms or your misuse of the Services.

14. Termination

You may stop using the Services at any time and can delete your App account as described in our Privacy Policy. We may suspend or end your access to the Services if you break these Terms. Sections that by their nature should continue to apply will survive termination.

15. Severability and entire agreement

If any part of these Terms is found to be unenforceable, the rest will continue to apply. These Terms and the policies referred to in them are the entire agreement between you and us about the Services. Our failure to enforce any right is not a waiver of that right.

16. Governing law

These Terms are governed by the laws of Sweden. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and nothing in these Terms affects those rights.

17. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available on this page, with the date it was last updated. Continued use of the Services after changes are posted means you accept the updated Terms.
